Our service entails assessment of dispute or removal eligibility facts and debt review processes compliance with debt review regulations as prescribed in Section 86 of the NCA.
Where transgression of the regulations is established, we are authorised in terms of Section 136 regulation 50 of the NCA to act on your behalf to log a dispute with the NCR in order for the NCR initiate investigation and clearance process.

Only the NCR can investigate and finalise resolution of the dispute and the clearance of the debt review flag.

The NCR estimated resolution time-frame is 7 - 30 days depending on the complexity of an individual situation. The most complex situations can be resolved in maximum 60 - 90 days

The estimated clearance time-frame mainly depends on your cooperation in supplying truthful information and submitting required mandatory documents in a timely manner.

How Free Debt Review Clearance Assessment Works

IMPORTANT
Entering and/or Withdrawal from the debt counselling is a legal process with specific prescribed regulations and procedures 
in terms of the National Credit Act
A consumer can only be placed under debt review when they voluntarily apply for debt counselling by submitting  a Form 16 application with an NCR registered debt counsellor
The debt counselling process is performed by the debt counsellor in a prescribed manner to determine if the consumer qualifies for debt review.
The debt counselling process should be concluded within a prescribed timeframe (60 days)
The debt counselling process is deemed complete once it has been made an order of the court
In terms of Section 136 of the NCA, you are entitled to dispute the debt counselling process or the debt review flag on your credit report. 
The dispute must be lodged using the NCR prescribed dispute form named Form 29
The NCR is obliged by law to investigate every dispute to establish and verify all the facts and to resolve the matter accordingly.

* Only the NCR can cause or facilitate the removal of the debt review flag from your credit records

 

When can a Debt Review Flag be Removed?
1. When you were unlawfully placed under debt review
2. When you were decieved and told it was something else
3. When you did not sign Fom 16 debt review applicaiton
4.. When you did not agree to or sign the restructured repayment arrangment 17.2
5. When the process was abandoned or not completed (there is no court order in place)
6. When the debt counsellor is no longer involved in debt counselling service
7. When you have settled all accounts that were placed under debt review
8. When you can supply substantial proof that you are no longer over-indebted

Assessment Process
The Assessment entails:
1. Drawing your credit record to establish: 
* Debt Counsellor details
* Debt Counsellor registration status
* Debt Counselling process status (stage)

2. The above details shall determine:
A. If your debt review situation can be resolved directly with the credit bureaus or
B. If your debt review situation requires the NCR dispute process.

A. Where it is determined that NCR intervention is not necessary:
* We shall proceed to liaise with the concerned parties and/or the credit bureaus for clearnce of the debt review flag
* Your assigned case manager shall finalize the acquisition of your updated 3inOne report with the credit bureaus.

B. Where NCR dispute process is deemed necessary:
* A dispute shall be lodged with NCR to investigate circumstances surrounding the debt review.

The assessment process is performed free. You are not under obligation to use NCRA service. 

 Registration and Assessment
1. Register for Debt Reveiw Clearance Assessment
2. A consultant shall call you to verify your registration details. 
3. Upload the mandatory clearance assessment questionnaire and prescribed dispute forms
4. Submit all documents with your ID and Proof of Address
5. Receive Free Credit Report  with Debt Review Status & Debt Counsellor details
6. Receive Recommended Clearance Action

Dispute/Clearance Process
When you decide to use the recommended Clearance Action
7. You will receive instruction to Activate Your File 
to initiate Clearance Process
8. Upon confirmation of File Activation we proceed to log a dispute on your behalf with NCR 
9. NCR shall conduct investigation and resolve the dispute within 7 - 30 days

  NONE-NCR CLEARANCE 

                               R500 Once-Off

This Fee is payable when:
1. You have received notification of confirmation of clearance
2. The fee covers costs to acquire your Clearance Certificate (where applicable) and/or your updated 3inOne Credit Report with the debt review flag removed.

This service fee applies mostly where:
* The debt review flag is unlawfully placed on your credit records. 
* The debt counsellor is no longer involved in debt counselling and cannot issue a clearance certificate
* The debt counsellor refuse to issue a clearance certificate

In the instance where the above applies, the debt review flag shall be removed within 7 days

     NCR DISPUTE CLEARANCE

                        R1 500 (R300 x 5 Months)

This Service Fee Entails:
<> File Activation (refundable) = R300
<> Clearance Service Fee = R1200
Total Service Fee = R1500 (R300 x 5 months)

The R300 File Activation Fee is refundable only when the NCR refuse to remove the debt review flag for any reason whatsovever 

In the instance where NCR intervention applies the NCR shall investigate and remove the debt review flag within 30 - 60 days

Power of Attorney

The power of attorney is required to authorize NCRA to access your credit reports from any Ncr registered Credit Bureaus and to act on your behalf to request concerned parties to cooperate and supply any information relating to your debt review situation.

NCR Dispute Form 29

The NCR Form 29 is a prescribed dispute form that must be submitted to the Ncr in order for the Ncr to open a file for the investigation of possible unlawfull processes or transgressesion of prescribed debt counselling regulations  and procedures.

Under certain circumstances, the Ncr might also request an affidavit to support your dispute.

Third Party Authorisation

In terms of Section 136 Regulation 50 of the NCA a third party authorisation form is required when you elect to appoint a third party representative to lodge a dispute on your behalf.

Where affidavit is required, at your instructions, the in-house legal practitioner shall draft the affidavit on your behalf.

Credit Bureau Reports

Once you are placed under debt review, the debt review flag shall be displayed on your credit  bureau record

The ultimate goal of the dispute is to remove the debt review flag from your credit records. 

If you are not certain that the debt review flag is displayed on your records, you may want to check your Credit Bureau Report to establish the Debt Counsellor details and the Debt Review Status (phase)

Dhs Status Guide

The Debt Help System is updated by Debt Counsellors and the NCR to indicate the status of the debt counselling progress (phase). 

The Dhs Status Guide is a set of prescribed status codes which indicates the actions taken or should be taken by theDebt Counsellors, the NCR and the Credit Bureaus.  

Most importantly is that the status codes dictates the status displayed on the credit bureau report. 

In the event that the Dhs status code is not D4 and not (Court order granted on the credit bureau) after 60 days of the application, it means the debt review process has expired and the debt review flag should be removed from your credit records.
